The website, www.dorothysflorist.co.za, is owned and operated by Dorothy’s Florist, Scottburgh Kwa-Zulu-Natal, herein after referred to as “Dorothy’s Florist”.

Dorothy’s Florist welcomes visitors to purchase our products online.

Visitors to the Website (“Users” or “you”), including those Users who purchase any products on the website (“Purchasers”) are bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not continue to use the Website. Your continued use of the Website will constitute an acceptance of the Terms and Conditions by you.

Our Website enables Users to shop for flower arrangements, hampers and gifts as supplied by Dorothy’s Florist.
We may change these Terms and Conditions from time to time. The latest version of these Terms and Conditions apply whenever you use the Website. You agree to read the latest version each time you visit the Website.

By using our Website or by the exchanging emails with us, you communicate with us by electronic means. You therefore agree that any and all agreements, notices, disclosures, or any other communications sent or received electronically satisfy any legal requirement, including but not limited to, the requirement that such communications should be “in writing”.

Dorothy’s Florist will always, to the best of our ability, ensure that product descriptions, images and information are as accurate as possible. However, product information, descriptions and images may not always with complete accuracy reflect the product sold. Dorothy’s Florist will not be held liable for slight product description, information or image discrepancies and Users understand that this content is not warranted as being free of error or omission.

All stock on offer is limited. Wherever possible, Dorothy’s Florist will ensure to show product availability with accuracy. However, should a situation arise where a product purchased is no longer available, Dorothy’s Florist will contact you as soon as possible to rectify the situation.

Dorothy’s Florist offers two Payment Options when purchasing through our website:

PayFast is a secure, online payment gateway through which all credit card or instant EFT payments are processed. When selecting this payment option, Users will be redirected to the PayFast secure payment gateway. Dorothy’s Florist DOES NOT store any credit card or banking details on our website.

Electronic Funds Transfer payments can be made directly into our bank account. Banking details will be provided to you upon choosing this payment option. Please note, the purchase date of your product using this payment method will be taken on the day your payment clears in our bank account – please allow 3 extra days for clearance should you choose this option.

Delivery of products purchased through Dorothy’s Florist is free of charge as stipulated in Delivery. All orders placed through Dorothy’s Florist are delivered to your door. Deliveries will only be made to physical addresses – please do not supply a postal address for delivery purposes and please ensure a responsible party is available on the date of delivery at the delivery address to sign and take delivery of your purchase. Should the courier schedule state your delivery will be arriving on a day where a responsible party will not be available to sign for and take delivery, please let us know within 24 hours of receipt of delivery notice so that we can make arrangements to change your delivery date. Should you neglect to notify us of this and couriers need to return at a later date without notice, you will incur a delivery charge of R200.
Customers will be notified when products are out for delivery and will be updated throughout the delivery process.

If upon receiving our flower or gift arrangement, you are not 100% satisfied, let us know within 48 hours and we will gladly collect and replace it at our expense or collect it and provide you with a refund. All refunds will take between three to ten working days to reflect.

Refunds can only be given to the account holder (sender) and not the recipient of the gift. If the gift is still in its original condition and we have stock of something else which you or your special someone would prefer, we’ll gladly exchange it for them. However, please note that we may have to charge a collection and redelivery fee.

We offer use of this Website “as is” and “as available”, and its use by you is at your own risk. Neither we, nor our members nor its employees, consultants, advisors, affiliates, agents or suppliers shall be responsible for any damages or loss resulting from or relating to the use of our Website, or any of its content, irrespective of the cause of the damages.

Any material downloaded or otherwise obtained through the use of our Website is done at your own discretion and risk and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material, including any damages resulting from computer viruses and other similar causes.

We make no representations or warranties, implied or otherwise, that, amongst others, the content and technology of our Website are free from errors or omissions or that the service will be free of interruption or errors. We nevertheless ask you to report any problems or errors you may find on our Website to dorothysflorist@gmail.com

We cannot be held responsible for security breaches occurring on your electronic devices which may result due to the lack of adequate virus protection software / spy-ware on such devices.

It is your sole responsibility to satisfy yourself prior to accepting these Terms and Conditions that the service available from and through this Website will meet your individual requirements and be compatible with your software and/or hardware.

We are not responsible for any loss that results from:

  • any technical or other problem (including interruption , malfunction, downtime or other failure) that affects our website, system or online service or any database for any reason;
  • any problem affecting any goods or service provided by any other party, for example any telecommunication or internet service provider, electricity supplier, or local or other authority;
  • any loss of or damage to any personal information or other data caused directly or indirectly by technical problems, power failures, unlawful acts (such as data theft), any harmful computer program or virus, or because of your own negligence;
  • any order, investment decision or purchase or disposal of goods or services (including financial instrument or currency) from any other party based on any information on our Website; or
  • any event over which we have no direct control.

The Website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law. Dorothy’s Florist and you, the User, submit to the exclusive jurisdiction of the South African courts.
